Account Terms and Conditions

This Agreement is between fcs.net and a Customer (as defined by the fcs.net Online Registration Form) for Internet services. Customers agree to abide by the following:

1. Acceptable Use Policy

Please read this carefully. Failure to adhere to these terms may result in cancellation of your account. Similar restrictions are used by all Internet Service Providers.

fcs.net understands that using the Internet "properly" (as defined by the Internet community generally) can be very unclear and confusing. Our goal is to help you use the Internet most effectively, and to be able to take action against the few individuals who purposefully and repeatedly abuse the system. If you are new to the Internet and do not fully understand these points, please call fcs.net.

• fcs.net customers will not send unsolicited e-mail. Unsolicited e-mail is defined as any e-mail sent to an individual or group (whether the mailing list was bought or developed by the Customer) where the recipient or recipients have not specifically requested information or a response. E-mail includes information of any kind, advertisements, literary works, graphics, voice and video files, and any other material that can be contained in current or future implementations of e-mail.
• fcs.net customers will not post advertisements to USENET newsgroups unless the newsgroup specifically states in its FAQ that advertisements are acceptable.
• fcs.net customers will not use their Internet accounts to harass or abuse other members of the Internet community.
• fcs.net customers will not post copyrighted materials, whether written, graphic, or in any other form, to any public site without permission from the author or creator.
• fcs.net customers will not use their accounts for any unlawful purpose.

2. Account Information

The Service Begin Date is the day on which fcs.net activates the Customer's account. This service period extends for 1 month and is automatically renewed unless terminated by the Customer or fcs.net. fcs.net reserves the right to change its fees at any time. Fee changes take effect at the time of renewal. fcs.net reserves the right to terminate any account in violation of any term of this agreement.

All connections, unless otherwise noted on your invoice, are for one computer connection to the Internet at any given moment in time. A single computer connection to the Internet is defined as a single channel or modem connection.

3. No Warranties

fcs.net does not warrant any connection to, transmission over, or the results of the use of any network connection. fcs.net assumes no responsibility for any damage, loss, or expense suffered by the Customer, including but not limited to loss of data, delays, non-deliveries, mis-deliveries, or service interruption caused by fcs.net or Customer error, omission, or negligence. Use of this service and any information obtained using this service is at the Customer's risk. fcs.net does not accept any responsibility of the accuracy of, quality of, or actions taken in response to the information obtained through its services.

4. Use of Service

This service may be used only for lawful purposes. The transmission of information in violation of any local, state, federal, or international regulations is prohibited. This includes, but is not limited to, copyrighted, obscene, or threatening material, and material protected by trade secrets. The Customer agrees to indemnify and hold harmless fcs.net for any claims that arise from the Customer's use of the service. All services provided by the Customer either in part or in total using fcs.net's connection are subject to relevant local, state, federal, and international regulations. If fcs.net or other relevant authorities determine inappropriate usage of this service, fcs.net reserves the right to suspend or terminate the service immediately and without notification.

5. Service Coverage

This Agreement extends service to the Customer only, and not to any other organization or entity affiliated with the Customer. The Customer cannot resell Internet connections, or transfer the account to another individual or group.
